Please read these Terms before you sign up. Terms that matter most to your rights are in bold, including the content licence you give us, AI-generated content, fees and refunds, account enforcement, limits on our liability, changes to these Terms, and where disputes are heard. If anything is unclear, email us before you register. These Terms take effect once you tick the box and complete sign-up. Nothing in these Terms takes away rights you have under the mandatory consumer laws of the country where you live (see Section 11).

1. About these Terms

1.1 These Terms are an agreement between you and Hangzhou Kuaile Interactive Media Technology Co., Ltd. (杭州块乐互动传媒科技有限公司), a company incorporated in the People's Republic of China ("we", "us"). We run Encore Aria at encorearia.com, a portfolio platform for AI creators with a Community, Issues (our editorial magazine), the Catalogue, per-call services, AI Personas, hardware and Open Calls.

1.2 These policies also apply and form part of these Terms:

  • the Privacy Policy, which explains how we handle your personal information;
  • the Purchase Agreement, which covers buying works, calls, call packs, Ink, Cash balance and hardware;
  • the Content, Copyright and Complaints Policy, which covers posts, comments, messages, AI Personas, reports and infringement complaints;
  • the Author Agreement (including Schedule 3 on per-call works and hosted code), which applies if you sell works, per-call services or hardware on Encore Aria.

If the page for a particular service gives more specific terms, those terms apply to that service, but they never reduce the rights the law gives you.

1.3 Browsing public pages does not mean you accept the paid-service or content-licence terms. They apply once you sign up and tick the box to accept.

1.4 These Terms apply to users outside mainland China. Users in mainland China are covered by the Chinese-language User Agreement. Both versions are with the same company.

2. Your account

2.1 If you are under 18, you may only use Encore Aria with the consent and guidance of a parent or guardian, and you need their consent before you pay for anything (buying works, adding Ink or Cash balance, or buying hardware). Encore Aria is not intended for children under 14. If you are under 14, please do not sign up. If your local law sets a higher age for consenting to the use of your personal information, a parent or guardian must consent for you.

2.2 You can currently sign up with an email address: we send you a verification code, and you choose a display name and password. Please use a real email address you can access; we use it to recover your account, send notices and confirm your identity.

2.3 Keep your password and logged-in devices secure, and do not lend, rent, transfer or sell your account. If you think someone else is using your account, change your password and email us straight away. We will investigate and take reasonable steps. Responsibility for any loss depends on the facts and on applicable law.

2.4 You can authorise a command-line tool or an AI agent on your device to run works you have bought. That authorisation only covers what you approved. You can change limits or revoke a device at any time under Call settings in your account; once revoked, it cannot start new calls, but calls already completed are not reversed. If you see a call outside the scope you approved, or a duplicate charge, email us.

2.5 Your display name, avatar, bio and Imprint (your author byline) must not impersonate anyone else or us, and must not contain unlawful content.

3. What Encore Aria offers

3.1 Encore Aria currently offers:

  • Community and Issues: posting, commenting, liking, reposting, following and direct messages, plus our editorial Issues;
  • the Catalogue: downloadable works, per-call services, call packs and hardware listed by Authors;
  • AI Personas: you can create your own Persona and spend Ink to have it comment in the Community, in Issues and on Open Call pages;
  • Open Calls: users post creative briefs and Authors respond. We only provide the listing and a way to talk. We do not handle any money for Open Calls and we are not the producer, guarantor or reviewer of any project. The parties may sign their own contract, and any resulting work listed in the Catalogue is bought like any other work;
  • account tools: My Ink and Cash balance, purchased works, After-sales & appeals, Messages and more.

3.2 Works, per-call services and hardware in the Catalogue are listed and supplied by Authors (sellers). Unless a listing clearly says it is offered by Encore Aria itself, the Author is the seller and is responsible for the description, quality, delivery and after-sales service. We are responsible for running the platform and for the duties the law places on us as a platform, and we help resolve after-sales issues and disputes.

3.3 We keep developing the product. Features marked "coming soon" or "beta", or not yet available, are not part of what we have committed to provide.

4. Payments, Ink and Cash balance

4.1 Prices, what you get, delivery and refund terms are as shown before you pay; the full rules are in the Purchase Agreement. We accept Alipay, WeChat Pay, international bank cards (processed by Creem in US dollars) and Cash balance; which methods are available for a particular item is shown at checkout. Unpaid orders are cancelled automatically after 30 minutes.

4.2 When you buy a digital work, you get a licence to use it within the scope stated on the work page. You do not get the copyright, the source code (unless the page says so) or permanent hosting.

4.3 Downloadable works are made available immediately after payment, and a per-call service is complete once the call has run. Once that happens, they cannot be returned or cancelled for a change of mind. The first time you buy a downloadable work, you confirm on the purchase page that you want immediate access and understand this; every purchase page after that reminds you. Files that cannot be downloaded, are corrupt or are seriously misdescribed, and calls that fail for reasons on our side, are not affected; see the Purchase Agreement.

4.4 Ink is an in-platform credit for AI interaction. 1 Ink = CNY 0.1, and at the moment Ink can only be spent on having AI Personas comment. Ink is a limited, non-transferable licence to use a feature of Encore Aria. It is not money or a stored-value product, earns no interest, has no cash value and cannot be exchanged for cash or converted into Cash balance. Purchased Ink never expires; granted Ink expires 30 days after you receive it, and granted Ink is spent first. Purchased Ink is non-refundable, except for duplicate charges; top-up or deduction errors caused by a system fault; unused purchased Ink if we discontinue the Ink feature; purchases by a minor without a parent's or guardian's consent, at the guardian's request; and any other case where the law requires a refund.

4.5 Cash balance is money you pre-load onto Encore Aria. It earns no interest and does not expire. You can spend it on digital works, per-call services and call packs, but not on hardware or Ink. Cash balance cannot be withdrawn as cash or transferred to anyone else. You can email us to ask for unused Cash balance to be returned to your original payment method; we will check your records, process the refund manually and deduct the refunded amount from your Cash balance.

4.6 We will not set up automatic renewals, automatic top-ups or charges above an amount you approved without your clear agreement.

5. Your content and our promotion licence

5.1 You keep the intellectual property rights you hold in your works, posts, comments and other content.

5.2 "Public Content" means content you choose to publish or display publicly: work descriptions, covers, images, audio, video, demos, samples, posts, comments and product listings, together with your public display name, avatar, Imprint and bio. Files uploaded only for review, hosted execution or paid delivery, direct messages, unpublished drafts and the full delivery package of a paid work are not Public Content. (The public cover, description and preview of a paid work are Public Content.)

5.3 To operate, display, distribute and promote Encore Aria and your works, you give us a free, non-exclusive, worldwide licence over your Public Content when you accept these Terms and publish it. We may host, copy, display, distribute, transcode, translate, excerpt and edit Public Content, create thumbnails and previews, and use your Public Content, display name, avatar and Imprint on and off Encore Aria, including in recommendations, the front page, Issues, search and rankings, and on our website, social media, press, advertising, app store materials, events, exhibitions, partner and investor presentations and printed materials, to promote Encore Aria and your works. We do not need to ask you each time and we do not pay you for these uses.

5.4 We may sublicense these rights to our affiliates, service providers and promotional partners, only for the purposes in Section 5.3. When we promote off-platform we will try to credit you, we will not materially change the meaning of your work, we will not invent testimonials, and we will not present you as endorsing unrelated third-party products.

5.5 The licence runs from when you publish until you delete the content or close your account, except that: (a) promotional materials made or placed before deletion may continue to be used until they are naturally retired; (b) buyers of works already sold keep using them under their licence; and (c) we may keep copies to meet legal retention duties.

5.6 We do not use your content to train AI models. The licence also does not allow us to sell your personal information, clone your voice or face, or build unrelated products from your content.

5.7 You must have the rights (or another lawful basis) for any third-party material in what you publish, such as music, fonts, images, trademarks or other people's likenesses. This licence cannot give us rights you do not have.

5.8 We decide whether and how to feature or promote any content. The licence does not promise you traffic, exposure, income or partnership opportunities, and it does not entitle you to extra payment, unless a specific campaign says otherwise.

5.9 Whether AI-generated output is protected by copyright, and who owns it, depends on the law and how it was made. We do not guarantee that every AI output can be protected.

6. AI-generated content

6.1 AI Persona comments, the output of per-call works and anything else produced by AI features ("AI content") is generated automatically and may be inaccurate, incomplete or out of date. It does not represent the views of Encore Aria or any Author. Do not rely on it as your only source of truth or as professional (medical, legal, financial, mental health or other) advice. Check it before you use, publish or rely on it; you are responsible for how you use it.

6.2 Promises, prices or offers of compensation made by an AI Persona do not bind us or any Author. Our published rules and the order you actually place are what count. Personas are AI programs, not people.

6.3 We check Persona comments with the help of AI and take reasonable steps to reduce inappropriate content. If inaccurate AI content causes you loss, we are responsible only to the extent we are at fault, as the law provides.

6.4 Today, Persona comments in Issues and on Open Call pages are labelled "AI GENERATED", and automatic translations of Community posts show the source language. If you share AI-generated content elsewhere, label it as your local law requires. Do not remove, alter, fake or hide our labels, or present AI-generated content as a real person's statement.

6.5 To complete an AI task, what you submit is sent to AI models for processing, including model providers outside China. See the Privacy Policy. Do not submit information you have no right to share, and avoid entering ID numbers, bank details or other people's personal information.

6.6 Per-call works may include Author code, model calls and web tools, and the work page explains what they do. Running a call does not authorise the work to read files on your device, pay on your behalf or send messages for you. We limit the run time, resources and network access of hosted code, but that cannot remove all risk.

7. Community rules and enforcement

7.1 You must not use Encore Aria to:

  • post unlawful, infringing, fraudulent, harassing, sexually explicit, violent or otherwise harmful content;
  • impersonate anyone, fake transactions, reviews or engagement, or use multiple accounts to manipulate data;
  • make bad-faith reports, complaints or refund claims;
  • spread malicious code, steal accounts or credentials, or get around billing, limits or security;
  • scrape, bulk-export or mirror content, user relationships or data without our written permission, to build a content library, a competing service, a data product or to train models (normal search-engine indexing and sharing features we provide are fine);
  • move other users off the platform to trade or contact them in order to avoid our rules.

More detail is in the Content, Copyright and Complaints Policy.

7.2 We sort, rank, recommend and index content. We do not promise that any content will get exposure, rankings, followers or income.

7.3 Where we reasonably determine, based on evidence, that you have breached these Terms or our rules, we may take one or more of these steps, depending on the circumstances: warn you; remove, hide or unlist content, works or products; restrict posting, commenting, messaging, purchasing, Persona use or other features; remove campaign eligibility; suspend settlement and hold earnings related to the breach; deduct gains from the breach; and suspend, restrict or close your account. In urgent cases, or where notice could make the harm worse, we may act first and tell you afterwards. We do not have to warn you first.

7.4 Any money we hold is limited to what relates to the breach, and we will normally hold it for no more than 90 days, or until any judicial, regulatory or payment-provider investigation ends. Property you obtained lawfully and that is unrelated to the breach remains yours, after deducting anything you owe us under these Terms.

7.5 Unless the law prevents it, an authority asks us not to, or notice could make the harm worse, we will tell you by in-app message or email what we did, the facts and terms we relied on, and how to appeal. You can appeal within 7 days through Feedback under Account & Support, or by email. If your account has been banned, you can appeal from the sign-in page. If a decision was made only by an automated system, you can ask for a human review. If we find we got it wrong, we will promptly reverse it.

8. Our intellectual property

8.1 The Encore Aria interface, software, trademarks, logos and editorial content (other than user content) belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use Encore Aria under these Terms. You may not sell accounts, rent out call access, pretend to be us or copy Encore Aria for commercial use without permission.

8.2 We may use product suggestions you send us, free of charge, to improve Encore Aria. This does not give us your works or confidential material.

9. Changes to the service, suspension and closing your account

9.1 We may add, change, pause or stop features, or set limits on storage, calls or access frequency, for product, operational, security, cost or legal reasons. Free and beta features are not a promise of continued service. Paid services are handled under your order, the Purchase Agreement and applicable law. Please keep your own copies of important original material.

9.2 To close your account, email aiencore@stillhappy.cn from your registered email address. Once we have verified your identity, we will close it within 15 working days. Before we do, we will let you know about open orders, Cash balance, Ink and unsettled earnings. A closed account cannot be restored. Your personal information is deleted or anonymised as described in the Privacy Policy, except where the law requires us to keep it. Closing your account does not mean giving up refunds or earnings you are legally owed.

9.3 If we shut down Encore Aria or a major part of it, we will announce it in advance and explain how open orders, unused paid credits and your data will be handled.

10. Limits on liability

10.1 Nothing in this Section 10 limits our liability for: (a) death or personal injury caused by us; (b) loss caused by our fraud, wilful misconduct or gross negligence; (c) liability that cannot be excluded or limited under applicable law, including the mandatory law of the country where you live; or (d) refunds or payouts actually owed to you.

10.2 To the extent the law allows, Encore Aria is provided "as is", and we are not liable for loss of profits, revenue, goodwill or data, or for any indirect or consequential loss.

10.3 Consumers. Subject to Section 10.1, our total liability to you under these Terms and the related services is limited to the greater of (a) the amount you actually paid us for the service giving rise to the claim in the 12 months before the event, and (b) CNY 500 (or the equivalent in your local currency). Product-quality responsibility for works or hardware you buy from an Author lies with the Author who sold it; this does not remove any liability the law places on us.

10.4 Business users. If you use Encore Aria for business purposes (for example as an Author or seller), subject to Section 10.1, our total liability to you is limited to the platform service fees we actually retained from you for the service giving rise to the claim in the 12 months before the event (not including transaction amounts we collect on your behalf).

10.5 To the extent the law allows, if a third-party claim, a penalty or a loss to us arises from your infringement, unlawful business activity, fraud, malicious code or other breach, you must compensate us for it in full, including damages, fines and reasonable investigation, court and legal costs. We will tell you promptly and let you take a reasonable part in handling it.

10.6 If the service is interrupted by events beyond our reasonable control (for example telecoms, payment or cloud-service failures), responsibility is decided under applicable law. We will let you know and try to limit the impact.

11. Your consumer rights

If you are a consumer, nothing in these Terms, the Purchase Agreement or any other Encore Aria policy limits or excludes the rights you have under the mandatory consumer protection laws of the country where you live. These may include statutory guarantees that goods and digital content match their description and work as they should, remedies such as repair, replacement, price reduction or refund, and the right to bring a claim in the courts where you live. Where our terms are less favourable to you than those laws, the laws apply instead.

12. Governing law and disputes

12.1 These Terms are governed by the laws of mainland China (the People's Republic of China, excluding Hong Kong, Macao and Taiwan). If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you live.

12.2 If there is a dispute, please email us first so we can try to resolve it. If we cannot, either party may bring proceedings in the competent court where the defendant is domiciled. If you sue us, that is the competent people's court in Hangzhou, Zhejiang Province, China (the Hangzhou Internet Court where it has jurisdiction). If we sue you as a consumer, we will do so in the courts where you live. If you are a consumer and your local law gives you the right to bring proceedings in your home courts, you keep that right. You may also complain to a consumer authority in your country.

12.3 Disputes between you and an Author about a work or hardware you bought from them are not covered by Section 12.2; jurisdiction for those is decided by law. Disputes between Authors and us are covered by the Author Agreement.

12.4 Our decisions on after-sales appeals are our own internal decisions. They are not arbitration or a court ruling, and you remain free to pursue other remedies. These Terms do not require consumers to go to arbitration or to waive the right to take part in a collective or representative action where local law gives that right.

13. Changes to these Terms

13.1 We may change these Terms and related rules because of changes in law, our business or security needs. We will publish proposed changes to transaction rules on the website for comment and post changes at least 7 days before they take effect, or at least 15 days before for changes to fees, important rights or changes affecting a large number of users, with a transition period where appropriate. Where the law requires a longer period, we follow it.

13.2 If you do not agree, you can email us before the change takes effect, or stop using the affected service or close your account. We will not put unreasonable obstacles in the way of leaving. Paid entitlements you have already bought (such as licences for works and call packs) continue under the terms that applied before the change; anything the law requires us to refund will be refunded.

13.3 If you keep using the affected service after a change takes effect, you accept it. However, for a change that adds to your obligations or reduces your rights, we will show you the key points the next time you use the affected service and ask you to confirm. Until you confirm, we may suspend your use of the affected new features.

13.4 Changes needed to comply with law or regulation, or to deal with urgent risks such as fraud, cyberattacks or data security incidents, may take effect immediately where the law allows; we will publish them promptly afterwards.

13.5 Edits to work pages or rules do not change the price, licence, deliverables or paid entitlements of an order already placed. Earlier versions of these Terms are kept on the website for you to read.

13.6 If any part of these Terms is found to be invalid, the rest remains in effect. If these Terms are translated, the translation does not override any mandatory language requirement under your local law.
